1. Acceptance of Terms
By using Berry's Car Service ("we," "us," or "our") transportation
services, booking through our website, mobile app, or phone, you
("you" or "customer") agree to be bound by these Terms of Service
("Terms"). If you do not agree to these Terms, please do not use our
services.
2. Services Description

Berry's Car Service provides ground transportation services
including but not limited to:
- Point-to-point transportation
- Airport transfers
- Scheduled rides
- Recurring ride services
- Corporate transportation accounts
3. Booking and Reservations

Reservations can be made via phone (845-848-5555), website, or
mobile app
- We require advance notice for reservations when possible
- Same-day service is subject to availability

You must provide accurate pickup and destination information

Changes or cancellations must be made according to our
cancellation policy
4. Payment Terms

Payment is due at time of service unless pre-arranged corporate
account
- We accept cash, credit cards, and electronic payments
- Rates are based on distance, time, and service type

Additional charges may apply for waiting time, tolls, parking
fees, or special requests

Corporate accounts are subject to separate billing agreements
5. Cancellation Policy
- Cancellations made 1+ hours before pickup: No charge

Cancellations made less than 1 hour before pickup: May be
subject to cancellation fee
- No-shows will be charged the full fare amount
6. Driver and Vehicle Standards
- All drivers are licensed, insured, and background checked
- Vehicles are regularly inspected and maintained

We reserve the right to refuse service for safety or legal
reasons
7. Liability and Insurance

Berry's Car Service maintains commercial insurance as required
by law

Our liability is limited to the maximum extent permitted by law

Customers are responsible for personal belongings left in
vehicles

We are not liable for delays due to traffic, weather, or
circumstances beyond our control
8. Customer Responsibilities
- Provide accurate contact and location information
- Be ready at scheduled pickup time
- Follow all vehicle safety rules and local laws
- Treat drivers and vehicles with respect
- Report any issues immediately
9. SMS/Text Messaging Terms & Conditions
By providing your phone number to Berry's Car Service, you consent
to receive informational text messages including ride confirmations,
driver updates, ETA notifications, and service alerts. Message
frequency varies based on your ride activity. Message and data rates
may apply.
For help, reply HELP or contact us at 845-848-5555. You can opt out
at any time by replying STOP. Berry's Car Service will send one
final confirmation message to notify you that you have successfully
opted out.
10. Prohibited Uses
You may not use our services for:
- Illegal activities
- Transportation of prohibited items
- Harassment of drivers or staff
- Fraudulent bookings or payments
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BERRY'S CAR SERVICE SHALL
NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR
CONSEQUENTIAL DAMAGES.
12. Governing Law
These Terms are governed by the laws of New York State. Any disputes
will be resolved in the courts of Rockland County, New York.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Updated
Terms will be posted on our website with the revision date.
